The supreme court has issued an emergency order temporarily blocking full Snap food aid payments.
The high court’s order came after the Trump administration asked a federal appeals court on Friday to block a judge’s order that it distribute November’s full monthly food stamp benefits amid a US federal government shutdown.
After that request to block was denied, the Trump administration turned to the supreme court in a further attempt to block the order to fully fund Snap food aid payments.
The application to stay reads: “If forced to transfer funds to Snap to make full November allotments, there is no means for the government to recoup those expenditures – which is quintessential irreparable harm. Once those payments are made, there is every indication that the States will promptly disburse them. And once disbursed, the government will be un-able to recover any funds. Worse, these harms will only compound if the decision below stands.
It’s shocking because of how easy it was for them to do the decent thing. Literally all they had to do was nothing, but they paid for the lawyers and did the work, and made a conscious effort to fuck over the most vulnerable people in the country.

I’m very much not a lawyer, I’m not even from the US, but even I know that irreparable harm is harm which may not be cured by monetary compensation. THIS IS LITERALLY JUST MONEY GIVEN TO THE STATES. IF THE DECISION IS LATER OVERTURNED THE STATES CAN JUST GIVE THE MONEY BACK FROM THEIR BUDGETS. This is the dumbest fucking shit I’ve read for a while.
You know what is quintessential irreparable harm? Medical complications or death from starvation. Which I sincerely wish upon the fucking monsters who signed this decision, which is illegal even by the already crooked pro-capitalist amerikkkan laws.

It’s even dumber than that. This was an order to use emergency funds set aside specifically for SNAP. Going before the Supreme Court and saying they don’t have the funding is admitting that they stole that shit.
Its slightly more complicated. One judge ruled they have to use the emergency funds, another ruling said they have to provide full funding. Emergency funding is like ~5B, full snap payments for a month is like ~9B. So they would have to pull funding elsewhere, like from ICE. Which they totally should be forced to do, but that’s just my opinion.
Anyone not wondering where Trump got the money to fund ICE during the shutdown is a fool.

When you say they do you mean the military? The military has no arrest authority over civilians. The posse comitatus act specifically says that. When I was in the military we spent two days going over the posse comitatus act and what the military is allowed to do. That was part of my officer training. There is no legal recourse for the military to do anything. If civilian leaders give illegal orders the only thing the military can do is look at the civilian leader and say no that’s against the Constitution and we cannot do that. It was set up specifically like that to keep the military from trying to take over. Because you know a general could say hey civilian guy giving illegal orders we can arrest you or the general could say hey civilian in any situation we can arrest you and hold you indefinitely. The purging of the brass in the military and especially the upper echelon officers is really what is disturbing about this. The fact that there are military officers that are willing to go against the Constitution is even more deeply disturbing. I’m not really going to blame some 19-year-old recruit that just come out of basic because they don’t know any better but they’re NCOs and officer corps sure as fuck does. And that’s where the real problem lies. Just like Bannon recently that the Republicans better take over the institutions or we’re all going to jail in 2028 so he knows they know that all this shit is illegal but here we are

When the local national guard units are deployed for riot control, usually they do a relatively good job. In the 1992 LA riots, there were a couple thousand CA guardsmen (I can’t find a solid number) plus a couple thousand more other law enforcement, over 12,000 arrests, and 63 dead, of whom 9 were shot by police and only one by the national guard.

Here’s one analysis:
Jackson gets this application because it’s from the 1st circuit, and she is assigned to initially handle all shadow docket matters from the 1st circuit. By writing this admin stay, she potentially keeps the full court from stepping in and doing it for her. And this way she gets to set the 48 hour limit. This could cause the whole case to be decided one way or another a lot faster.
The supreme court let the trans passport case sit on the shadow “emergency” docket for 48 days. This stay gives the 1st circuit approx the weekend to make their decision, then the 48 hour deadline puts some oomph on the rest of scotus to make their decision.
If Justice Jackson did nothing, and 5 votes on the court intervened to issue a stay at 1 am, then there would be no 48 hour limit.

When you consider the strategy here, and the potential downsides if Jackson didn’t issue this stay, it makes more sense why she did it.

This is absolute bullshit. Those funds have already been allocated by Congress in the 2023 Farm Bill. The money is already authorized for use for the next few years. They don’t need to “find it” somewhere else, or “get it back” at some future date. It is literally sitting ina find account, waiting to be used.
The only reason these benefits would be held up for any reason during a government shut down, is if the staff in charge of distributing that money are not currently working. That’s what the $6 billion emergency fund is for. Paying the federal employees needed to make sure that money gets to its pre-authorized destination.

You’re assuming Trump hasn’t already appropriated those funds and handed them to ICE or his rich buddies. How the hell can he loot the government if courts are allowed to force him to spend money where Congress tells him to spend it?

Donald Trump has a certain degree of immunity for official acts only. The people who work for him do not. The only thing protecting any of them right now, is the fact that he’s still in office. Once he’s out, everyone who committed crimes on his behalf, are all going to be charged.
And even he is open to prosecution for anything that can be proven to have been committed for purely personal gain (which is almost everything he does).
You may not remember this, but every single one of the lawyers who did his dirty work after the 2020 election, to try and flip the results…have all been found guilty of crimes and misdemeanors…and had their law licenses taken away. This shit does have consequences. Trump himself is just really good at gaming the system, thanks to the fact that he has so much money to burn on his own defense. But even that will only go so far.
Speaking of lawyers, I just read an article today about all the lawyers that have been fired from the DOJ, and how they are all forming law firms with various specialties going after MAGA crimes - immigration issues, fired federal workers, etc. By firing all those lawyers, he seeded the legal resistance that will give legal authority to the punishments of him and his henchmen.

If the lawyers are organizing against MAGA, it’s a pretty good bet that the Generals are, too.

Getting the government back via “legal” means is over.
Time to start thinking outside the box.
No, it isn’t, not yet. We still have the 2026 Midterms, and the 2028 Presidential Election. How MAGA handles those elections will tell the tale. If they manage to game the system again, or worse, end elections with some excuse, THEN legal means have failed, and it’s time for out-of-rhe-box solutions.
I understand that people are frustrated, and want action, and that’s good. But if we respect the Constitution (which is the very foundation of this battle with MAGA) we have to reserve that righteous indignation for the moment, and let this play out until they violate the Constitution so badly that it becomes ineffective. Something like cancelling elections.
Then we have the moral authority to act decisively. And when it happens, we will have plenty of support. All the military leadership they fired, all the legal power the they fired, etc., will all support the resistance.
In addition, Trump and MAGA are REVILED by the rest of the world. Not only will our allies refuse to support Trump, they are likely to heavily support his opposition. Even those that claim to be his friend hate him, and are unlikely to help him in any substantial way, and risk retaliation and sanctions from the other nations.
If you respect the Constitution, you have to let it play out, but we all see where this is going.
By the time people like you realize the legal means have long failed, it will be too late.
The constitution has a clause for this specifically: the 2nd amendment.

If you do respect the Constitution, then let it play out, and respond to the MAGA response. For one I agree with you. I hate how fast everything is going to shit too but I still have hope and want to avoid mass bloodshed and conflict. If there’s a legal way to take these monsters to the gallows, we should pursue every avenue.

I want to remind people that immediately after Jan 6, people started whining that they’d all get away with it, and the government wasn’t doing anything.
But the FBI combed through every video they could find, including many posted by the Traitors themselves. They identified the worst behaved, and posted their faces EVERYWHERE. Immediately, family, neighbors, co-workers, etc. started turning them in, and they started to make arrests. The DoJ went on to convict more than 1000 people, and many got multi-year sentences.
And throughout that entire process, people were constantly posting complaints about how the govt wasn’t doing ANYTHING!
It’s kind of the same thing now. NOTHING is not what’s happening. Everyday, MAGA gets closer to the Red Lines that they cannot cross without massive resistance. They are in the midst of one lighter red line, which is killing health care in America. It wont trigger a rebellion, but when the rebellion finally happens, there will be so many people who have suffered medically and economically by MAGAs psychopathic health care policies, that they will enthusiastically support it.
For me, the biggest Red Line would be if they disappear certain close people in my life who are members of vulnerable communities. If ANYTHING were to happen any of those people, I would have nothing left to lose, and I would become a VERY dangerous man indeed.
I’m older, and I have come to the realization that dying an old man in my sleep would be a waste. I’m coming to terms with the idea that my life may have a twist ending that I never anticipated, but is starting to come into focus.
